Service Terms & Usage Guidelines

Spatie BV offers you with OnePush a Software as a Service on an as-is basis. OnePush functions as an email marketing platform where we take care of the hosting. You can use OnePush to send out marketing campaigns, transactional emails and email automations. OnePush offers several options to send out these emails. You can choose between several email delivery services or use your own SMTP server. OnePush can also be integrated into your own systems by using an API. OnePush will perform all its obligations with due diligence according to the industry standards.

2.1 Subscription and Payment

OnePush works on a subscription basis. You pay us a base license fee on a monthly basis in advance. Your first payment happens therefore before the license starts and all following payments happen before the start of each subsequent month. On top of that you pay an additional usage cost based on the volume of your sent emails. These additional fees are due at the end of each month and will be invoiced together with each monthly license fee.

2.2 Payment Processing

All payments concerning the payment of your OnePush subscription shall be handled by Stripe in accordance with its terms and conditions. Spatie BV does not store any of your payment details.

2.3 Email Requirement

For purchasing a subscription to OnePush, a valid email address is needed.

Spatie BV is the owner or licensee of all rights in relation to OnePush, including any and all copyrights under Belgian law.

You agree not to:

• Modify, copy, sublicense, or reverse engineer OnePush
• Use malware or misrepresent your identity
• Use the service in violation of rights or laws
• Otherwise misuse the service

We may terminate or suspend your access at any time for suspected unauthorized use or non-compliance. You can terminate your use, but no refunds on paid license fees, and all usage costs remain due. Terms continue to apply while you use the service.

We may update OnePush functionalities at our discretion without notice. Support is via chat within the platform; we do not offer staff training.

Your subscription grants usage rights; we retain ownership of the platform, code, structure, trade secrets, and copyrights under Belgian law.

We process personal data on your behalf. You act as the controller under GDPR; we act as processor. Consent to DPA & Privacy Policy is required. We strongly recommend avoiding the use of sensitive personal data.

OnePush is provided "as is." We do not guarantee it will meet your requirements or be error-free. All use is at your own risk; we disclaim warranties and responsibility for consequences of misuse.

You agree to indemnify and hold us harmless from third-party claims arising from your improper use, violation of Terms, or misuse of your account.

Some components may have separate licenses; you're responsible for obtaining any necessary ones not included in your subscription.

If any provision is unlawful or unenforceable, it is severable; the rest of the Terms stand. We endeavor to replace invalid provisions to keep objectives intact.

We reserve the right to modify or replace parts of these Terms at any time. If materially changed, we'll give clear notice. Continued use after changes means acceptance.
